Rent Reporting Terms of Service

These Rent Reporting Terms of Service ("Rent Reporting Terms") supplement and are incorporated into EarnIn’s General Terms of Service (the "General Terms"). Capitalized terms used but not defined in these Rent Reporting Terms have the meanings given in the General Terms. In the event of any conflict between these Rent Reporting Terms and the General Terms, these Rent Reporting Terms will control with respect to the Rent Reporting Service described below.
By enrolling in or using the Rent Reporting Service, you agree to these Rent Reporting Terms. If you do not agree, do not enroll in or use the Rent Reporting Service. Additionally, these Rent Reporting Terms may be updated from time to time, please check back occasionally. By continuing to use the Rent Reporting Services after an update, you are agreeing to the latest version. 
IMPORTANT NOTICES: (I) THE RENT REPORTING SERVICE IS POWERED BY ESUSU, INC., A THIRD-PARTY SERVICE PROVIDER. BY ENROLLING, YOU WILL ALSO BE SUBJECT TO ESUSU’S TERMS AND CONDITIONS AND PRIVACY POLICY. (II) THE RENT REPORTING SERVICE IS SUBJECT TO A MONTHLY SUBSCRIPTION FEE. SEE SECTION 3 BELOW. (III) EARNIN IS NOT A CREDIT BUREAU, CREDIT REPAIR ORGANIZATION, OR CONSUMER REPORTING AGENCY AND DOES NOT GUARANTEE ANY IMPROVEMENT IN YOUR CREDIT SCORE. 
1. THE RENT REPORTING SERVICE
EarnIn offers a paid monthly subscription to an embedded rent reporting service (the "Rent Reporting Service") that enables eligible EarnIn users who are renters to have their on-time monthly rent payments reported to Equifax, Experian, and TransUnion (the “Bureaus”). The Rent Reporting Service is operated by Esusu, Inc. (“Esusu”), a third-party service provider, and is accessed through the EarnIn app. Access requires payment of a monthly Subscription Fee as described in Section 3. 
By subscribing, you authorize EarnIn to transmit your payment and identity information to Esusu, and you authorize Esusu to report your on-time monthly rent payments (“Payment Information”) to the Bureaus, along with any additional information necessary to verify your identity or otherwise enable reporting, such as your name, date of birth, address, and lease information. 
You also confirm that: (i) the lease information you provide is for your primary residence; (ii) the same rent is not currently being reported to any Bureau by any other third party, including another rent reporting service; and (iii) the information you provide in connection with the Rent Reporting Service is accurate and complete.
Subject to the then-current Esusu Terms and Conditions, the Rent Reporting Service reports on-time rent payments on a monthly basis to the Bureaus. Upon your enrollment, the Rent Reporting Service will make commercially reasonable efforts to report up to 24 months of your prior rent payment history to the Bureaus, to the extent such data is available and meets Bureau requirements. The Rent Reporting Service reports payments monthly but does not control whether or how quickly those payments are included in your credit report or credit score. Because only on-time payments are reported, the number of months of positive payment history reflected in your credit file may fluctuate based on your rent payment history.
EarnIn cannot, and does not, guarantee any improvement to your credit score as a result of the Rent Reporting Service. The Rent Reporting Service is not a credit repair service. 
2. ELIGIBILITY
To be eligible to use the Rent Reporting Service, and in addition to meeting any of EarnIn’s general eligibility requirements as outlined in the General Terms, you must:
  • be 18 years of age or older;
  • reside in the United States;
  • be a party to a valid, active residential lease agreement at your primary residence;
  • have a valid Social Security number;
  • provide accurate information about your current lease, including your landlord or property manager, property address, and monthly rent amount;
  • be enrolled in EarnIn’s Credit Monitoring service (if you are not enrolled at the time you sign up for the Rent Reporting Service, you will be enrolled in Credit Monitoring as part of the onboarding process); and
  • meet Esusu’s then-current eligibility and enrollment criteria, as determined by Esusu in its sole discretion.
In addition, you may not enroll in the Rent Reporting Service if the same rent payment obligation is already being reported to any consumer reporting agency by your landlord, property manager, another rent reporting service, or any other third party. EarnIn may suspend your access to the Rent Reporting Service, and Esusu independently reserves the right to terminate enrollment under Esusu’s Terms and Conditions, including if duplicate reporting is discovered. 
EarnIn and Esusu each reserve the right to determine or modify eligibility criteria at their respective sole discretion. Eligibility for the Rent Reporting Service does not guarantee that any Bureau will accept, display, or score your Payment Information.
3. SUBSCRIPTION FEE AND BILLING
a. Subscription Fee
The Rent Reporting Service is offered as part of an EarnIn subscription (the "Subscription"). Access to the Rent Reporting Service requires payment of a recurring monthly Subscription fee (the "Subscription Fee") as disclosed to you at the time of enrollment and as may be updated from time to time in accordance with these Rent Reporting Terms. 
b. Billing Cycle and Payment
Upon subscribing, EarnIn will debit the Subscription Fee from your linked bank account each month pursuant to the Rent Reporting Service ACH Debit Authorization you execute at enrollment. Your Subscription is billed monthly, beginning on your enrollment date, with each billing cycle covering one calendar month. The first Subscription Fee will be charged at the time you enroll in the Rent Reporting Service. Subsequent Subscription Fees will be charged on the same calendar date each month (“Billing Date”). If your Billing Date does not exist in a given calendar month (for example, the 31st in a 30-day month), the fee will be charged on the first day of the following month. If the Billing Date falls on a weekend or a federal banking holiday, the charge will be initiated on the next business day.
Your Subscription will continue on a monthly basis unless and until you cancel or EarnIn terminates it. You must cancel your Subscription before the start of the next billing cycle to avoid being charged the Subscription Fee for that cycle. There is no proration of the Subscription Fee upon enrollment or cancellation. You will not receive a refund or partial credit for any unused portion of a billing period.
c. Fee Changes
EarnIn reserves the right to change the Subscription Fee at any time with 30 days’ advance notice. Your continued use of the Rent Reporting Service after the effective date of any fee change constitutes your acceptance of the new Subscription Fee. If you do not accept a fee change, you may cancel your Subscription before the change takes effect. Any Subscription Fee change will be reflected in the next applicable billing cycle.
d. No Refunds
All Subscription Fees are non-refundable except as required by applicable law. EarnIn does not provide refunds or credits for partial billing periods, unused access, or cancellations that take effect before the end of a billing cycle.
4. HOW THE RENT REPORTING SERVICE WORKS
a. Rent Reporting Service Provider (Esusu)
The Rent Reporting Service is powered by a third-party provider, Esusu. Esusu is responsible for receiving your Payment Information, furnishing it to the Bureaus, and managing any disputes related to reported data. By enrolling in the Rent Reporting Service, you acknowledge and agree that:
  • You will be subject to Esusu’s Terms and Conditions and Esusu’s Privacy Policy. Please read these documents in their entirety before enrolling.
  • Esusu is not an agent of EarnIn, and EarnIn is not responsible for Esusu’s acts or omissions in connection with the Rent Reporting Service.
  • In the event of any conflict between these Rent Reporting Terms and Esusu’s Terms and Conditions with respect to the operation of the Rent Reporting Service itself, Esusu’s Terms and Conditions will control, except that with respect to the subject matter addressed in the sections of Esusu's Terms and Conditions entitled “REGISTRATION,” “FEES AND PAYMENTS,” and “CANCELLATION, REFUNDS,” these Rent Reporting Terms — specifically Section 2 (Eligibility), Section 3 (Subscription Fee and Billing), and Section 7 (Cancellation, Suspension, and Termination), respectively — will control as to your enrollment in and use of the Rent Reporting Service through the EarnIn app.
b. Enrollment and Onboarding
To enroll in the Rent Reporting Service, you will be directed through an enrollment flow within the EarnIn app that is powered by Esusu. You will be required to confirm or provide information, which may include the following:
  • Social Security number and date of birth;
  • Zip code;
  • Current lease address, lease start date, lease end date, and monthly rent amount; and
  • Confirmation of your linked bank account used for rent payments.
EarnIn will transmit your identity information and bank transaction data to Esusu. Esusu will use this data to verify your identity, identify your rent payments from your transaction history, and determine your eligibility for the service. If Esusu determines you are ineligible, you will not be enrolled or charged the Subscription Fee.
c. Bank Connection Health
The Rent Reporting Service relies on your linked bank account connection to identify rent payments. If your bank connection becomes unhealthy or is disconnected, EarnIn will notify you and prompt you to reconnect. If the connection remains unhealthy for a sustained period, the Rent Reporting Service may be unable to detect your rent payments, resulting in unreported Payment Information to the Bureaus. If the connection is not restored and no rent payments can be detected for an extended period of time, your Subscription may be terminated. 
d. Scope of Incorporated Esusu Terms 
The reference to Esusu's Terms and Conditions in these Rent Reporting Terms is limited to the provisions relevant to Esusu's furnishing of your Payment Information to the Bureaus and its administration of related disputes, as described in this Section 4. The following sections of Esusu's Terms and Conditions do not apply to, and are not incorporated into, your enrollment in or use of the Rent Reporting Service through the EarnIn app: “PROMOTIONS AND INCENTIVES”; “ESUSU PAY”; “ESUSU PASSPORT”; “MARKETPLACE SERVICES”; “SPECIAL TERMS REGARDING THE APPLE APP STORE”; “BETA SERVICES”; “USE OF THE ESUSU APPS”; and “UPDATES TO THE ESUSU APPS.” Those sections govern products and features offered directly through Esusu's own platforms (esusurent.com, the Esusu mobile app, and related services) and are not part of the Rent Reporting Service as made available to you through EarnIn. More generally, this exclusion applies regardless of how Esusu later renames, renumbers, or restructures its Terms and Conditions, and extends to any Esusu feature or functionality offered directly through Esusu's own platforms rather than through the integrated Rent Reporting Service. The list above is illustrative, not exhaustive.
5. BUREAU REPORTING LIMITATIONS AND CREDIT SCORE DISCLAIMERS
EarnIn does not guarantee that any Bureau will accept, display, or score your Payment Information. Each Bureau sets and may change its own requirements for rental payment data without notice, and EarnIn does not control how Bureaus process, display, or score reported data. Once reporting begins, your credit history may also be negatively impacted if the Rent Reporting Service stops or becomes inconsistent for any reason, including cancellation of your Subscription.
EarnIn shall not be liable for any claims, damages, or adverse impact on your credit score or credit history arising from: (i) any Bureau’s decision not to accept, display, or score your Payment Information; (ii) the cessation or interruption of reporting for any reason; or (iii) any act or omission by Esusu in furnishing your Payment Information.
6. YOUR RIGHTS UNDER THE FAIR CREDIT REPORTING ACT
You have rights under the Fair Credit Reporting Act, including the right to dispute inaccurate information in your credit file. A summary of your major rights is available from the Consumer Financial Protection Bureau here: Fair Credit Reporting Act Summary of Rights.
Esusu’s Terms and Conditions also contain a full summary of your FCRA rights and the dispute process applicable to the Rent Reporting Service, including the procedures Esusu follows when investigating disputes as the furnisher of your Payment Information.
7. CANCELLATION, SUSPENSION, AND TERMINATION
a. How to Cancel
You may cancel your Subscription (and, with it, your enrollment in the Rent Reporting Service) at any time by accessing the Settings within the EarnIn app, navigating to the My Subscription section, and unsubscribing from the Rent Reporting Service. 
b. Effect of Cancellation 
If you cancel your Subscription, you will retain access to the Rent Reporting Service until the end of your current billing cycle. At the end of the billing cycle, your Subscription will terminate and reporting will stop. No prorated refunds will be issued for the remaining portion of the billing period. You will still owe any unpaid Subscription Fees accrued prior to cancellation.
c. Suspension or Termination
EarnIn may suspend or terminate your access to the Rent Reporting Service at any time, with or without advance notice, and for any reason, including if:
  • You are found to be ineligible for the service at enrollment or at any subsequent time;
  • We reasonably suspect fraud, misrepresentation, or abuse of the service;
  • Your Subscription payment is not recovered within the applicable grace period;
  • Your EarnIn account is closed or terminated; or
  • We are required to do so by applicable law.
Esusu also reserves the right to suspend or terminate access under the circumstances described in Esusu’s Terms and Conditions. You will still owe any unpaid Subscription Fees accrued prior to suspension or termination. A suspension or termination of the Rent Reporting Service is not a denial of credit.
d. Reactivation
If your Subscription is canceled and not yet terminated (i.e., still within the current billing period), you may reactivate your Subscription before the end of the billing period without losing access. Once your Subscription is terminated, you may create a new Subscription; however, a new enrollment may require you to go through the full onboarding process again, and there is no guarantee you will be found eligible for the Rent Reporting Service or that prior reporting history will be reinstated.
8. MODIFICATIONS
EarnIn may modify these Rent Reporting Terms at any time. If EarnIn makes material changes, EarnIn will notify you in advance consistent with the General Terms. Continued use of the Rent Reporting Service after the effective date of any change constitutes your acceptance of the updated Rent Reporting Terms. If you do not agree with any changes, you should cancel your Subscription and discontinue use of the Rent Reporting Services.
EarnIn also reserves the right to modify, suspend, or discontinue the Rent Reporting Service, or any features thereof, at any time. EarnIn will provide reasonable advance notice of material changes to or discontinuation of the Rent Reporting Service where practicable.
9. MISCELLANOUS
These Rent Reporting Terms supplement and are subject to EarnIn’s General Terms, including the Disclaimer of Warranties, Limitation of Liability, Indemnification provisions, Arbitration and Dispute Resolution provisions, and all other general terms set forth therein, each of which applies to the Rent Reporting Service and is incorporated here by reference. Should a dispute arise regarding these terms or the Rent Reporting Service, to the extent the dispute relates to Esusu’s provision of the Rent Reporting Service, such disputes are governed by Esusu’s Terms and Conditions, including Esusu’s separate arbitration provision, provided that any dispute arising from or relating to (i) registration or eligibility for the Rent Reporting Service (Section 2), (ii) the Subscription Fee or billing (Section 3), or (iii) cancellation, suspension, or termination of the Rent Reporting Service (Section 7) will be governed by these Rent Reporting Terms and EarnIn's General Terms, including the Arbitration and Dispute Resolution provisions incorporated therein, and not by Esusu's Terms and Conditions or Esusu's arbitration provision. If any provision of these Rent Reporting Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
