SPONSOR.
The Sweepstakes is sponsored by Activehours, Inc. / d.b.a. EarnIn, located at 200 Portage Ave, Palo Alto, CA 94306 (“Sponsor”).
ELIGIBILITY. The EarnIn Budget Bracket Sweepstakes (“Sweepstakes”) is open to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry (the "Entrant"). Persons in any of the following categories are not eligible to participate: (a) employees, officers, directors or agents of Sponsor, or of any of its respective parents, subsidiaries, affiliates, or any advertising or promotion agencies involved in this Sweepstakes ("Promotion Entities"); (b) individuals engaged in the development, production or distribution of materials for the Sweepstakes; and (c) persons who are in the immediate family of any person in any of the preceding categories (including mother, father, sister, brother, daughter, son, spouse, grandmother, grandfather, children or grandchildren), regardless of where they live; or persons who reside in the same household, whether related or not, as any person in any of the preceding categories. All eligibility is subject to all federal, state and local laws and regulations.
SWEEPSTAKES PERIOD. The Sweepstakes begins on 03/14/2023 at 12:01 AM Pacific Time (“PT”) and ends on 03/31/2023 at 11:59 PM Pacific Time (“PT”) ("Sweepstakes Period"). The TikTok time stamp on EarnIn’s database computer will be the official timekeeping record for this Sweepstakes.
HOW TO ENTER. During the Sweepstakes Period, locate Sponsor’s bracket filter on TikTok, create a short video using the filter, and post it on your public TikTok feed (“Post”). Your Post must include the following two hashtags: #BudgetBracket and #EarnInGiveaway. Only Posts with both hashtags can be counted as entries.
ALTERNATE METHOD OF ENTRY. You may also participate by printing your full name, address, and daytime telephone number on a 3” x 5” card and mailing the card in a sealed envelope to: EarnIn, Attention: EarnIn Marketing - Budget Bracket, PO Box 46, Palo Alto, CA 94301.
Entries must be received by March 31, 2023 BY 11:50 PM PT. Limit one alternate entry per person. EarnIn is not responsible for lost, late, incomplete, misdirected, damaged, postage-due, or illegible entries. Once submitted, entries become the sole property of EarnIn and will not be acknowledged or returned.
ADDITIONAL ENTRY RULES. All Posts must: (a) be the exclusive original work of the entrant; (b) be in keeping with the Sponsor’s image, (c) not defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon the rights of any person or entity, including but not limited to copyright, trademark, privacy or publicity, (d) not contain any commercial/corporate advertising, including but not limited to corporate logos, brand names, and slogans other than the Sponsor's, (e) not depict any conduct or content that is unsafe, immoral, obscene or otherwise inappropriate as determined by Sponsor in its sole and absolute discretion; and (f) not have been submitted in any other Sweepstakes or won any prize.
Each entrant represents and warrants that he/she has obtained permission from any and all recognizable persons other than the entrant depicted or mentioned in a Post and agrees, upon request, to furnish written proof of such permission. Failure to meet any of the requirements above, or to otherwise comply with these Official Rules, may result in disqualification. Sponsor reserves the right to delete or blur any inappropriate content from a submission without disqualifying the entry where, in Sponsor’s determination, such change does not materially alter the submission and the entrant has otherwise attempted in good faith to comply with these Official Rules.
LIMIT. One (1) entry per person/TikTok account. Any attempt to enter more than once via multiple names, email addresses, TikTok accounts, or any other means, may result in disqualification from this and any other promotional offerings from Sponsor. Use of any macro, bot, script or other automated means to submit entries is prohibited. Proof of posting is not proof of accessibility of the posting to Sponsor or anyone else. Sponsor's database computer is the official time-keeping device for the Sweepstakes. Entries will not be acknowledged or returned. In the event of a dispute over the identity of an entrant, entry will be deemed submitted by the authorized account holder of the email address associated with the social media account used to post the entry. "Authorized account holder" is defined as the natural person who is assigned to an email address or other similar account associated with the relevant social media account.
PUBLICITY/USAGE RIGHTS. By entering, you warrant and represent that your video and Post have been created by you as an original work and that all required third-party releases (if any) have been obtained in writing, and you further agree acknowledge and agree that Sponsor (and those acting with its authorization) may copy, reproduce, edit, broadcast and otherwise use your submission in any way in any medium whether now existing or later discovered, worldwide, in perpetuity, including but not limited to posting online on Sponsor’s social media pages. Sponsor reserves the right to remove or reject any content it deems inappropriate for any reason. Except where prohibited, participation in the Sweepstakes and/or receipt or use of any prize further constitutes the winner’s consent for use of his/her name, likeness, voice, opinions, statements, biographical information, and/or hometown and state for promotional or advertising purposes in any media, worldwide, now known or hereafter developed, in perpetuity, without further review, notification, payment, or consideration (unless prohibited by law).
WINNER SELECTION/NOTIFICATION. On or about 04/07/2023, the Sponsor will select potential winners in a random drawing from among all eligible entries received. Potential winners will be notified via _TikTok Direct Message (”DM”), on or about 04/10/2023. No liability is assumed for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If potential winner does not respond to any winner notification within seven (7) days, or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner may be disqualified and an alternate winner may be selected. Judges’ decisions are final and binding in all matters relating to this Sweepstakes. Each potential winner may be required to execute a Declaration of Eligibility, Liability Release, and a Publicity Release (“Prize Claim Documents”). If a potential winner fails to comply with Sponsor’s requests for Prize Claim Documents, is found to be ineligible, or cannot or does not comply with these Official Rules, such potential winner may be disqualified and prize may be awarded to an alternate winner. If the potential winner is at least 18 but still considered a minor in their jurisdiction of residence, at Sponsor’s option, the applicable prize either may be awarded in the name of their parent or legal guardian of the winner, or the parent or legal guardian of winner may be required to ratify and sign the Prize Claim Documents and any other required documents. Prizes will be fulfilled within ten (10) weeks after the conclusion of the Sweepstakes.
PRIZES/ODDS. Four (4) prizes are available: One (1) $500 Amazon gift card. Amazon is not a sponsor of or in any way affiliated with this Sweepstakes. Gift cards are subject to issuer’s standard terms. Prizes are non-transferable, and no cash alternative or prize substitution will be allowed, except in Sponsor’s discretion. A substitute of comparable or greater value may be awarded if a prize listed becomes unavailable for any reason. Each winner is responsible for all federal, state and/or local taxes, and for any other fees or costs associated with acceptance or use of any prize.
Odds: The odds of winning depend on the number of entries received.
ADDITIONAL RULES. Entry materials/data that have been tampered with or altered are void. No responsibility is assumed for: (i) lost, late, misdirected, damaged, garbled, incomplete or illegible entries, all of which are void; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, paying internet connection or internet access, electronic, mobile device, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems; or (iii) any injury or damage to entrant's or any other person's computer or mobile device related to or resulting from participating in the Sweepstakes.
By participating, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the judges, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any Sweepstakes it sponsors any person it believes has intentionally violated these Official Rules; and (ii) suspend, modify or terminate the Sweepstakes, in whole or in part, if Sponsor believes, in its sole discretion, that technical problems, malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity, proper conduct or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winner from all eligible, non-suspect entries unaffected by the problem. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
RELEASE OF LIABILITY. By participating in the Sweepstakes, you (and if you are a minor, your parent or legal guardian) agree that the Sweepstakes Entities (a) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from acceptance, awarding, receipt, possession and/or use or misuse of any prize, and (b) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose.
By participating in the Sweepstakes, you (and if you are a minor, your parent or legal guardian) further agree that: (a) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (b) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses; and (d) these Rules and all disputes shall be governed by the internal laws of the state of California, without regard to principles of conflicts of laws, any disputes shall be resolved exclusively in the state or federal courts in the state of California, and you expressly consent to the jurisdiction of said courts and waive any objection thereto. For New Jersey residents: Nothing herein prohibits recovery of damages or attorneys’ fees where required by statute.
WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND SPONSOR HEREBY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

TIKTOK. By participating, you release TiKTok and its parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize. The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, TikTok.
