EarnIn Card Autopay Agreement
This EarnIn Card Autopay Agreement (“Autopay Agreement”) is made between you (“you” or “your”) and Evolve Bank & Trust (“we”, “us”, “our”) and sets forth the terms and conditions of your use of our automatic payment service, which enables you to authorize the transfer of funds from another deposit account you have with us to pay down your Card Balance on your EarnIn Card (“Autopay”). This Autopay Agreement will govern Autopay. Capitalized terms in this Agreement have the meaning assigned to them in your Cardholder and Security Agreement unless otherwise stated herein.
Your Cardholder and Security Agreement with us requires you to pay your Statement Balance in full by the Payment Due Date provided in your EarnIn Card Statement. By entering into this Autopay Agreement, you are choosing to use Autopay and are choosing a bi-monthly automatic payment option, to make payments on your EarnIn Card. As further described below, you authorize us to initiate automatic payments of funds from your Secured Account to repay the undisputed amount outstanding on your EarnIn Card, as displayed in the EarnIn Mobile App (“Card Balance"), on or around the 1st and 15th day of each and every month unless in accordance with this Autopay Agreement, (1) you have instructed us to skip or stop a specific payment, or (2) you have revoked this authorization, or (3) your EarnIn Card Statement Balance is paid in full and your EarnIn Card is closed.
How it works
With Autopay, we will automatically deduct payments on or around the 1st and 15th of every month from your Secured Account up to the amount of your Card Balance. If your Card Balance is higher than the amount of funds in your Secured Account, we will transfer the full amount in your Secured Account to make a partial payment of your Card Balance.
You may access your scheduled Autopay payments and any past payments using Autopay by accessing and viewing your EarnIn Card Account in the EarnIn Mobile App.
Autopay Authorization for Bi-Monthly Payments
By agreeing to this Autopay Agreement, you authorize us to issue an electronic funds transfer from funds available in your Secured Account to repay your Card Balance on your EarnIn Card, on or around the 1st and 15th of each and every month in accordance with the terms of this Autopay Agreement. You authorize us to make such a transfer in the amount of your Card Balance, or in the event that the amount of funds in your Secured Account is less than your Card Balance, you authorize us to transfer the full amount of funds available in your Secured Account and apply such funds as partial payment towards your Card Balance. You acknowledge that the amount of each payment you authorize to be made from your Secured Account on or around the 1st and 15th of every month may vary from the amount of the previous payment based on your Card Balance and the funds available in your Secured Account. All payments will be between $0 and the amount of your Card Balance (the “Range”). You have the right to receive notice of any payment that varies in amount from the previous payment, but agree that you will only receive notice where such payment falls outside of the Range. You acknowledge that you may view your Card Balance at any time in your Card Account on the EarnIn Mobile App.
In addition, you agree and authorize us to make any debits or credits to your Secured Account that are necessary and required to correct any errors to that account. If any 1st or 15th date is not a Business Day, the payment will be processed on the next Business Day. For purposes of this authorization, "Business Day" means Monday through Friday, excluding federal banking holidays. If any Autopay payment attempt fails, you agree and authorize us to re-initiate such payment up to 2 additional times, as permitted by law and applicable payment network rules.
How to Cancel Autopay
This authorization will remain in full force and effect until you notify us that you wish to revoke this authorization by calling our Servicer at 888-537-9883 or by contacting our Servicer via their live chat feature in the EarnIn Mobile App at least 3 Business Days before your next scheduled Autopay payment. Your revocation notice, when received by us, will be deemed effective on the 3rd Business Day prior to your then scheduled Payment Due Date (“Revocation Date”). If we do not receive your revocation notice by the Revocation Date, your Autopay payment will not be cancelled or revoked and your revocation will not apply until the next month’s scheduled Autopay Payment Due Date. We assume no responsibility for damages or losses, costs or expenses as a result of not receiving your revocation notice or for any payment that is processed through our Autopay services for any revocation notice that is received after the Revocation Date. It is your responsibility to ensure any revocation notice is properly provided and received by us on or before any Revocation Date.
We may cancel your enrollment in Autopay at any time and for any reason without penalty or fee. If Autopay is cancelled by you or us, you will still be responsible for paying your Statement Balance by the Payment Due Date. Cancelling Autopay will not affect your duty to repay your Statement Balance. This Autopay authorization in no way limits your right to stop payment of a preauthorized electronic transfer under federal law and you may do so by contacting our Servicer.
HOW TO SKIP A BI-MONTHLY TRANSFER
You may request to skip one or more bi-monthly payment without penalty or fee. If you skip a bi-monthly payment, you will still be responsible for paying your Statement Balance by the Payment Due Date. In order to skip a payment, you must notify us 3 Business Days prior to your then scheduled Payment Due Date. If we do not receive notice of you request within the required time frame, your Autopay payment will not be skipped. When you instruct us to skip a payment, your authorization for future Autopay payments is still in effect. The bi-monthly payments will resume in accordance with the next scheduled payment and continue in accordance with the terms of this Autopay Agreement. If you want to skip any additional payments, you will need to go through this process again. You understand that skipping a payment does not cancel your Autopay enrollment or authorization.
You acknowledge that you have received a copy of this Autopay authorization and can access it at any time through your EarnIn Card Account in the EarnIn Mobile App. Please retain a copy of this Autopay Agreement with your records as it contains your agreement and authorization to use our Autopay services to remit payments from your Secured Account to your EarnIn Card Balance.
